GENERAL TERMS AND CONDITIONS FOR ONLINE AND ON SITE PURCHASES

Version 2026/10

1. SCOPE

1.1. These General Terms and Conditions apply to the purchase and booking of services provided by Donauturm Aussichtsturm- und Restaurantbetriebsgesellschaft m.b.H., Donauturmplatz 1, 1220 Vienna (hereinafter referred to as “Donauturm”), through the online shop at https://shop.donauturm.at and to purchases made on site at the ticket counter or front desk, provided that these Terms and Conditions are incorporated into the respective contract. Individual products are also subject to the additional conditions stated in the respective offer. In the event of a conflict, individually agreed terms, particularly those in contracts with business and distribution partners, take precedence over these Terms and Conditions.

1.2. The customer's general terms and conditions shall form part of the contract only if Donauturm has expressly confirmed this in writing. Acts performed in fulfilment of the contract shall expressly not constitute acceptance of contractual terms that differ from these Terms and Conditions.

1.3. The contract languages are German and English. The German version applies to contracts concluded through the German-language version of the shop; the English version applies to contracts concluded through the English-language version of the shop.

2. OFFERS AND CONCLUSION OF CONTRACT

2.1. The presentation of products in the online shop does not constitute a binding offer, but an invitation to the customer to place an order. By clicking the “Order with obligation to pay” button, the customer submits a binding offer to conclude the contract. The contract is concluded as soon as Donauturm expressly accepts the order, makes the booked ticket or voucher available, or sends a confirmation of acceptance, whichever occurs first. An automated acknowledgement of receipt of the order does not in itself constitute acceptance unless it expressly states otherwise.

2.2. Donauturm reserves the right to reject offers from potential customers without stating reasons or to decline to enter into a contractual relationship with customers.

2.3. The customer must provide all information required during checkout or when creating a customer account completely and truthfully. This includes, in particular, their first and last name, an address at which they can receive correspondence, a valid email address and, where applicable, the company name and required information on authority to represent the company. Changes to information required to process the order must be reported to Donauturm without delay. Where a customer account exists, the information stored in it must be updated accordingly.

2.4. Reduced-price and free tickets and proof of eligibility

Donauturm offers reduced-price or free tickets to certain groups of people. Current prices and available ticket categories are stated in the online shop or at the ticket counter.

Reduced rates are offered, in particular, to the following groups:

  • Seniors aged 65 and over;
  • Students up to and including the age of 27;
  • Young people aged 15 to 19 inclusive;
  • Children aged 6 to 14 inclusive;
  • Young children aged 3 to 5 inclusive;
  • People with a documented degree of disability of at least 50%: separate rates are offered for adults and for children and young people aged 3 to 17 inclusive;
  • People undertaking civilian service or compulsory military service;
  • Active military personnel;
  • Embassy staff;
  • Accompanying persons of people with a documented degree of disability of at least 50%, provided that the need for assistance is recorded in the disability pass or comparable official documentation. The accompanying person's ticket is valid only when visiting together with the person being accompanied.

Children under 3 receive a free ticket when accompanied by an adult. The free ticket is available at the ticket counter.

Wheelchair users receive their free admission ticket exclusively on site. The published access and safety rules apply to their visit; in particular, a suitable accompanying person is required.

The requirements for the respective reduction must be met on the day of the visit. The reduction is personal and may not be used by someone who does not meet the requirements of the booked ticket category.

Donauturm is entitled to request suitable, valid proof of eligibility for the reduced or free rate on admission. Such proof includes, in particular:

  • Official photo identification or suitable proof of age for age-dependent rates;
  • A valid student ID or comparable current confirmation of student status for the student rate;
  • Valid service, military or armed forces identification for rates for people undertaking civilian service or compulsory military service and for military personnel;
  • Valid staff identification or comparable confirmation from the respective embassy for embassy staff rates;
  • A valid Austrian disability pass or comparable official Austrian or foreign documentation showing a degree of disability of at least 50% for the reduced rate for people with disabilities.

For the accompanying person's rate, the valid disability pass or comparable official documentation of the person being accompanied must be presented and must also show the need for assistance.

If suitable, valid proof of eligibility cannot be presented on admission, there is no entitlement to reduced-price or free admission. In that case, admission is possible only after payment of the difference to the regular admission price applicable on the day of the visit or to the appropriate ticket category. Admission may be refused if the price difference is not paid.

A refund of a reduced-price ticket due to missing, invalid or insufficient proof of eligibility is excluded. Mandatory statutory rights remain unaffected.

2.5. Whether a service can be made available or used before payment depends on the payment method selected or agreed at the time of purchase and the conditions of the respective product. Where advance payment is required, the service is generally made available after full payment has been received. Where payment by invoice has been agreed, the displayed or individually agreed payment terms apply. The provisions on activation of annual passes in clause 6.3 remain unaffected.

3. PRICES AND PAYMENT TERMS

3.1. Unless expressly agreed or stated otherwise, all prices are in euros and include VAT.

3.2. Donauturm reserves the right to adjust prices in the future.

3.3. For online orders, the payment methods offered during checkout are available. The time at which payment must be made and when it falls due depend on the selected payment method and the conditions displayed before completion of the order. Where payment by invoice has been agreed, the payment deadline stated on the invoice applies, subject to any overriding individual agreement. For on-site purchases, the payment methods offered there and the agreed payment terms apply.

3.4. If a chargeback occurs before the service begins, the ticket or voucher immediately becomes invalid.

4. DIGITAL PROVISION OF TICKETS VOUCHERS AND ORDER DOCUMENTS

4.1. Tickets

Tickets purchased online are provided as digital QR codes in accordance with the respective offer. They may be displayed on a suitable device. Printing is not required. The customer must ensure that the QR code can be presented in a readable form on admission.

4.2. Admission using a QR code

Admission is granted upon presentation and verification of a valid QR code. If the customer uses their own device, they are responsible for ensuring that it works. If the QR code cannot be presented due to a problem with the customer's device for which the customer alone is responsible, this does not give rise to an entitlement to admission without a ticket. For offers without a QR code, admission follows the procedure specified in the respective offer. Mandatory statutory rights remain unaffected.

4.3. Digital wallets

Where technically available, Donauturm admission tickets may be saved in Apple Wallet or Google Wallet. For combination tickets, this option applies only to those components for which a wallet function is expressly offered.

4.4. Vouchers and invoices

Vouchers purchased online and invoices relating to the order are sent digitally or made available through a download associated with the order. The customer may download and save these documents.

4.5. Email address

Emails from the Danube Tower shall be deemed received once they have been sent to the email address most recently provided by the customer. The customer is responsible for ensuring that this email address remains accessible and can receive emails. This includes, in particular, maintaining a functioning mailbox, appropriately configuring spam filters and ensuring sufficient available storage space.

4.6. Transfer and use of discount codes

The customer must protect tickets, QR codes and voucher codes against unauthorised use. Authorised transfer is permitted only where the respective product is not personal and its conditions allow transfer.

Discount, reduced-price and promotional codes must be entered in the designated field before the order is completed. Before submitting the order, the customer should check whether the price reduction is displayed in the order summary. If the order is completed at the displayed price without the code being applied, there is generally no entitlement to have the code applied retrospectively or to receive a refund of the price difference. This does not apply where a valid code could not be redeemed due to an error for which Donauturm is responsible; mandatory statutory rights remain unaffected.

Donauturm may block tickets, vouchers and codes that have demonstrably been manipulated or used unlawfully. Mandatory statutory rights remain unaffected.

4.7. Tickets purchased on site

Tickets purchased on site at the ticket counter or front desk are subject to the respective conditions of use and admission for the booked product.

4.8. Documents relating to online orders

Donauturm provides the customer with a confirmation of their online order and the documents applicable to that order. These include, in particular, the General Terms and Conditions in force at the time the contract is concluded, the information on the right of withdrawal and its statutory exceptions applicable to the purchased services and, where a statutory right of withdrawal exists, the statutory model withdrawal form. The documents are assigned to the respective order and made available as PDF files that can be saved, through a personal download link included in the confirmation email. Subsequent changes to these documents do not replace the versions made available for the order. The contract confirmation, together with the required information, is provided on a durable medium within a reasonable period after conclusion of the contract, but no later than delivery of the goods or before the provision of services begins.

5. RIGHT OF WITHDRAWAL WITHDRAWAL FUNCTION AND CANCELLATION

5.1. Exercising the right of withdrawal

Consumers have the right to withdraw from a distance contract within fourteen days without giving any reason, provided that a statutory right of withdrawal exists for the contract concerned and no statutory exception applies.

For service contracts, the withdrawal period begins on the day the contract is concluded. The day on which the contract is concluded is not counted when calculating the period. Clause 5.3 also applies to monetary vouchers purchased online.

To exercise the right of withdrawal, the consumer must inform Donauturm of their decision to withdraw from the contract by means of an unequivocal statement.

Withdrawal may be declared by post or email, or through the electronic withdrawal function provided on the online interface at https://shop.donauturm.at/vertrag-widerrufen/. The consumer may also use the statutory model withdrawal form. Use of this form is not mandatory.

When the electronic withdrawal function is used, the consumer receives an acknowledgement of receipt without delay on a durable medium, in particular by email. This contains the content of the withdrawal statement and the date and time of its receipt.

To meet the withdrawal deadline, it is sufficient for the consumer to send their withdrawal statement before the withdrawal period expires.

Providing the electronic withdrawal function does not create a right of withdrawal where such a right does not exist or is excluded under the statutory provisions.

5.2. Annual passes and immediate commencement of services

If, during checkout, the consumer expressly requests that Donauturm begin performing the contract before the statutory withdrawal period expires, the annual pass is activated immediately after full payment has been received and may be used straight away.

During checkout, the consumer also expressly confirms that they have acknowledged that their right of withdrawal is extinguished once Donauturm has fully performed the contract.

If the consumer validly withdraws from the contract within the statutory withdrawal period after the annual pass's validity period has already begun, the annual pass becomes invalid and is blocked upon receipt of the withdrawal statement.

In that case, the consumer must pay a reasonable amount for services already provided up to receipt of the withdrawal statement. This amount is calculated in proportion to the total price agreed in the contract and the extent of the services provided up to withdrawal. Where the statutory requirements for a proportionate payment obligation are met, the calculation is based on time. The annual pass price actually paid is divided by the number of days on which the pass can be used within the agreed validity period. The resulting daily amount is multiplied by the number of usable days that have already elapsed up to receipt of the withdrawal statement. Contractually excluded dates and closure days are not counted as usable days in either period. The amount calculated in this way is deducted from the annual pass price to be refunded.

On the activation date and the date on which the withdrawal statement is received, only a proportion of the daily amount is taken into account. This proportion corresponds to the ratio of the opening hours during which the annual pass was already usable on that day to the total regular opening hours for that day. If activation and receipt of the withdrawal statement occur on the same day, only the usable period between those two events is taken into account. There is no rounding up to full days.

A proportionate payment obligation exists only if, before the contract was concluded, the consumer was duly informed of their right of withdrawal, the immediate commencement of services and the resulting legal consequences, and expressly requested that services begin during the withdrawal period. First use of the annual pass does not automatically result in the complete extinguishment of the right of withdrawal.

5.3. Monetary vouchers

Monetary vouchers purchased online are generally subject to a statutory right of withdrawal of fourteen days. The withdrawal period begins upon receipt of the voucher. The day of receipt is not counted when calculating the period.

In the event of a valid withdrawal, the monetary voucher concerned is blocked and can no longer be redeemed. Once withdrawal has been declared, the voucher code must not be used or transferred to third parties.

If the monetary voucher has already been fully or partially redeemed before withdrawal is declared, the requirements and legal consequences of withdrawal are governed by the statutory provisions and assessed on a case-by-case basis.

For vouchers valid exclusively for a leisure service at a date or during a period already specified, the right of withdrawal may be excluded under clause 5.4.

Further provisions on the validity, use and redemption of monetary vouchers are set out in clause 6.1 of these Terms and Conditions.

5.4. Exclusion of the right of withdrawal for services booked for a specified date or period

Under section 18(1)(10) of the Austrian Distance and Off-Premises Contracts Act (Fern- und Auswärtsgeschäfte-Gesetz, FAGG), there is no statutory right of withdrawal for services related to leisure activities or for the supply of food and beverages where the contract provides for performance at a specific date or during a specific period.

This exclusion applies, in particular, to:

  • Admission tickets for a specified visit date or timeslot;
  • Slide tickets for a specified visit date or timeslot;
  • Event tickets, in particular for New Year's Eve, Valentine's Day and other special events;
  • Guided tours on a specified date;
  • Combination tickets for a specified date or period;
  • Additional services booked for a specified date, insofar as they fall within a statutory exception, in particular cakes supplied as food on an agreed date and romance packages related to a leisure service booked for a specified date;
  • Vouchers valid exclusively for a specific leisure service at a date or during a period already specified.

There is no statutory fourteen-day right of withdrawal for these services. Providing the electronic withdrawal function does not create a right of withdrawal for these services either.

Voluntary cancellation, rebooking or refund options are available only where expressly provided for in the respective product offer or product-specific conditions.

Mandatory statutory rights of the consumer, in particular in the event of cancellation, failure by Donauturm to provide the service or failure to provide it in accordance with the contract, remain unaffected.

5.5. Consequences of a valid withdrawal

In the event of a valid withdrawal, Donauturm refunds all payments received from the consumer, including any delivery costs, without delay and no later than fourteen days from the day on which Donauturm receives the withdrawal statement.

This excludes additional costs resulting from the consumer choosing a type of delivery other than the least expensive standard delivery offered by Donauturm.

The refund is generally made using the same means of payment that the consumer used for the original payment, unless expressly agreed otherwise. The consumer is not charged any additional fees for the refund.

If the consumer expressly requested that a service begin during the withdrawal period, a reasonable amount is payable for services already provided up to receipt of the withdrawal statement, provided that the statutory requirements for a proportionate payment obligation are met.

Services already duly provided and legally permissible proportionate charges may be taken into account when making the refund.

5.6. Contractual cancellation

Irrespective of the statutory right of withdrawal, cancellation, rebooking or refunds are available only where expressly provided for in the respective product-specific conditions.

Mandatory statutory rights of the consumer, in particular in the event of non-performance, failure to provide the service in accordance with the contract, statutory warranty rights or cancellation by Donauturm, remain unaffected.

6. PRODUCT SPECIFIC PROVISIONS

6.1. Monetary vouchers

Monetary vouchers represent a monetary credit with Donauturm and are valid for 30 years from the date of issue. They become effective only once the purchase price has been paid in full.

Monetary vouchers may be redeemed for the designated services in accordance with the stated redemption conditions. The monetary vouchers currently offered can only be redeemed in full in a single transaction. Partial redemption is not currently possible. Monetary vouchers must not be used to purchase further vouchers.

Redemption is possible only for the service areas designated for this purpose by Donauturm. Use for events, events organised by Donauturm or other offers expressly excluded from voucher redemption is not permitted. The applicable redemption conditions are stated in the respective offer.

Consumers generally have the statutory right of withdrawal set out in section 5 of these Terms and Conditions for monetary vouchers purchased online. The withdrawal period is 14 days and begins upon receipt of the voucher. There is no statutory right of withdrawal under the Austrian Distance and Off-Premises Contracts Act (FAGG) for monetary vouchers where both the order and the conclusion of the contract take place directly on Donauturm's business premises. Other mandatory statutory rights and expressly granted goodwill arrangements remain unaffected.

In the event of a valid withdrawal, the voucher concerned is blocked and can no longer be redeemed. Once withdrawal has been declared, the voucher code must not be used or transferred to third parties. If the voucher has already been fully or partially redeemed before withdrawal is declared, the requirements and legal consequences of withdrawal are governed by the statutory provisions.

6.2. Admission slide event and combination tickets

The following provisions also apply to group tickets and admission tickets for school pupils and their accompanying persons. The requirements stated in the respective offer before completion of the booking also apply, in particular those concerning minimum group size, proof of eligibility and accompanying persons. In the event of a conflict, individually agreed terms for group, school or travel agency bookings take precedence in accordance with clause 1.1.

6.2.1. Validity

Admission and slide tickets are valid exclusively on the booked visit date. The selected timeslot determines the period for priority access via the Fast Lane. If the customer arrives late, entitlement to priority access may lapse. The ticket may still be used for regular admission on the booked visit date, subject to opening hours, available capacity and operational and safety-related restrictions.

6.2.2. Withdrawal rebooking and refunds

For contracts for services related to leisure activities, there is no statutory right of withdrawal under section 18(1)(10) FAGG where the contract provides for performance at a specific date or during a specific period. This applies, in particular, to admission, slide, event and combination tickets for a specified visit date or timeslot.

Voluntary rebooking, cancellation or refunds are not available unless an expressly different arrangement is stated for the respective product or Donauturm expressly agrees to an exception. Mandatory statutory rights of the customer, in particular in the event of non-performance or defective performance for which Donauturm is responsible, remain unaffected.

6.2.3. Reductions

Reduced rates are granted only where the stated requirements are met and valid supporting documentation is presented. Personal discount or reduced-price codes must be redeemed before completion of the order. Redemption and any retrospective application are subject to the provisions in clause 4.6.

6.2.4. Children

Children under 14 may visit Donauturm only when accompanied by an adult. Children under 3 receive a free ticket at the ticket counter when accompanied by an adult, in accordance with the applicable tariff conditions.

6.2.5. Donauturm Slide

A valid admission ticket is also required to use the Donauturm Slide. Use is permitted from a minimum age of 6 years and a minimum height of 110 cm, up to a maximum body weight of 150 kg. The published safety and usage instructions also apply. Operation may be temporarily restricted or suspended, in particular for technical, operational or safety-related reasons. Slide Fun Packages are not personal and may be used by several people within their stated validity period.

6.3. Annual passes

Annual passes are personal and non-transferable. Valid official photo identification must be presented on request on each visit. Suitable proof of age and identity is acceptable for children and young children.

The annual pass is activated immediately after full payment has been received and the pass has been made available digitally, and may be used from that time onwards. For online purchases, commencement of services during the statutory withdrawal period requires the consumer to have expressly requested this before completing the order.

The validity period is one year from activation. The annual pass is not valid on 24 December, 31 December, 1 January or announced maintenance closure days.

Online contracts for annual passes are subject to the statutory withdrawal provisions in section 5 of these Terms and Conditions. The annual pass may be used during the statutory withdrawal period provided that the customer has expressly requested immediate commencement of services.

In the event of a valid withdrawal, the annual pass is blocked upon receipt of the withdrawal statement. A proportionate charge for services already provided up to that point may be charged or taken into account in the refund in accordance with the statutory provisions.

6.4. Additional services

Cancellations of additional services must be clearly communicated to Donauturm by email or through a cancellation function provided by Donauturm within the deadlines stated below. The relevant time is the time at which Donauturm receives the cancellation. For the purposes of these provisions, working days are Monday to Friday, excluding public holidays in Austria.

6.4.1. Romance packages

Romance packages may be cancelled free of charge no later than 23:59 on the last working day before the agreed service date. For later cancellations or where the booked service is not used, there is no contractual entitlement to a refund. The full agreed price remains payable, or a price already paid will not be refunded.

6.4.2. Cakes

Cakes may be ordered no later than five working days before the agreed service date. Cancellation free of charge is possible no later than 23:59 on the third working day before the agreed service date. For later cancellations or where the cake is not collected or the service is not used, there is no contractual entitlement to a refund. The full agreed price remains payable due to planning, preparation or production already undertaken, or a price already paid will not be refunded. Mandatory statutory rights of the customer, in particular in the event of non-performance or defective performance for which Donauturm is responsible, remain unaffected.

6.5. Events organised by Donauturm guided tours and workshops

6.5.1. Events organised by Donauturm

Events organised by Donauturm, in particular New Year's Eve events, Valentine's Day events and other special events, are leisure services provided at a specific date or during a specific period. There is no statutory right of withdrawal for these contracts under section 18(1)(10) FAGG. Voluntary cancellation, rebooking or refunds are not available unless expressly different conditions are stated for the respective event. If the customer cancels, fails to attend or does not use individual booked services, the full agreed price remains payable. A price already paid will not be refunded.

6.5.2. Guided tours

Guided tours are subject to the booking and cancellation conditions published for the respective tour. If a guided tour is booked for a specific date or period, there is no statutory right of withdrawal under section 18(1)(10) FAGG. Donauturm is entitled to cancel a guided tour if the expressly stated minimum number of participants is not reached or if the tour cannot take place for technical, operational, regulatory or safety-related reasons. If Donauturm cancels a guided tour, the customer will, at their choice, be offered a suitable alternative date or receive a refund of the price paid for the cancelled tour without delay. Rebooking to an alternative date takes place only with the customer's consent. Mandatory statutory rights of the customer remain unaffected.

6.5.3. Fear of heights workshops

Fear of heights workshops are subject to the booking conditions published in the respective offer. The booking is valid exclusively for the selected workshop date. Voluntary cancellation or rebooking is not available unless expressly stated otherwise in the respective offer. Whether a statutory right of withdrawal exists depends on the statutory requirements applicable to the booked workshop. Statutory rights of withdrawal and other mandatory rights remain unaffected. If Donauturm cancels the workshop, the price already paid for it will be refunded in full.

6.6. Opening hours and operational restrictions

Donauturm is entitled to change opening hours or temporarily close individual areas for technical, operational, regulatory or safety-related reasons. If the main booked service is cancelled in its entirety, the price paid for it will be refunded. In the event of partial non-performance or a substantial restriction, any claims depend on the nature and extent of the service not provided in accordance with the contract. Mandatory statutory rights remain unaffected.

7. LIABILITY

7.1. Alteration, falsification, unauthorised duplication for repeated use and any other misuse of digital tickets, QR codes or ticket numbers are prohibited. Saving and printing for their intended use, and transfer permitted under the respective product conditions, remain allowed. Personal tickets are non-transferable. Donauturm may block tickets that have demonstrably been manipulated or misused. Mandatory statutory rights remain unaffected.

7.2. Donauturm is liable for damage connected with use of the website or online shop in accordance with the statutory provisions. Mandatory statutory rights, in particular relating to personal injury, statutory warranties or product liability, remain unaffected.

7.3. House rules and safety regulations

Visits to Donauturm are subject to the published safety and usage instructions. Use of the Donauturm Slide is also subject to the House Rules for the Donauturm Slide. The respective provisions may be accessed before completion of the order at the following links:

Accessibility, safety information and house rules

https://www.donauturm.at/en/about-us/safety-instructions/

House Rules for the Donauturm Slide

https://www.donauturm.at/en/house-rules/

The customer is also required to inform the people they accompany of the applicable rules.

Statutory and regulatory safety requirements and instructions issued by Donauturm staff, supervisors and emergency personnel must be followed. This applies, in particular, to access restrictions, evacuation measures and use of the express lifts, observation levels and Donauturm Slide.

People who breach the house rules or safety regulations, fail to follow staff instructions or endanger the safety of other people or operations may be refused admission. Where necessary, they may be required to leave Donauturm or the area concerned.

If refusal of admission or removal is due to a breach for which the visitor is responsible, there is no entitlement to a refund of the ticket price. Mandatory statutory rights remain unaffected.

Regardless of the version published at the time the contract was concluded, safety measures mandatorily required by law or public authorities on the day of the visit, and staff instructions necessary for specific safety reasons, apply.

8. FINAL PROVISIONS

8.1. If a provision of a contract is invalid or unenforceable, this does not affect the validity or enforceability of the remaining provisions of the contract. In such a case, the contracting parties will endeavour to replace the invalid or unenforceable provision with a valid and enforceable provision that comes as close as possible to the purpose of the provision being replaced. This applies accordingly to supplementation of a contract where there are gaps in its provisions.

8.2. Contracts with Donauturm are governed by Austrian law, excluding the United Nations Convention on Contracts for the International Sale of Goods. Mandatory statutory provisions protecting consumers that apply in an individual case irrespective of this choice of law remain unaffected.

8.3. For contracts with business customers, the court with subject-matter jurisdiction at Donauturm's registered office shall have exclusive jurisdiction insofar as permitted by law. Contracts with consumers are subject to the statutory provisions on jurisdiction and venue.

8.4. Donauturm reserves the right to amend these Terms and Conditions at any time. Such amendments will be announced separately and apply only to contracts concluded after the amendment and announcement of the Terms and Conditions.
