Information on the Right of Withdrawal

This page provides information about the statutory right of withdrawal for contracts concluded online and allows you to submit a withdrawal declaration electronically.

Please note: The availability of the electronic withdrawal function does not mean that a statutory right of withdrawal applies to every contract concluded through the Donauturm online shop. Whether a withdrawal is valid will be assessed after receipt of the withdrawal declaration in accordance with the applicable statutory and contractual requirements.

After submitting the online form, you will immediately receive an acknowledgement of receipt by email. This acknowledgement will include the content of your withdrawal declaration as well as the date and time it was received.

The acknowledgement confirms only that your declaration has been received. It does not confirm that a statutory or contractual right of withdrawal exists or that you are entitled to a refund.

Statutory Right of Withdrawal

You have the right to withdraw from a contract within fourteen days without giving any reason, provided that a statutory right of withdrawal applies to the contract and no statutory exception applies.

For service contracts, the withdrawal period is fourteen days from the date on which the contract was concluded. The date on which the contract was concluded is not included when calculating the withdrawal period.

For monetary vouchers purchased online, the withdrawal period is fourteen days from receipt of the voucher. The day on which you receive the voucher is not included when calculating this period.

For contracts where both the order and the conclusion of the contract take place directly at Donauturm’s business premises, there is no statutory right of withdrawal under the Austrian Distance and Off-Premises Contracts Act (FAGG). Other mandatory statutory rights remain unaffected.

Exercising the Right of Withdrawal

To exercise your right of withdrawal, you must inform us of your decision to withdraw from the contract by means of a clear declaration.

You may use the statutory model withdrawal form provided below. However, use of the model form is not mandatory.

To meet the withdrawal deadline, it is sufficient for you to send your notification concerning the exercise of your right of withdrawal before the withdrawal period has expired.

Exceptions to the Right of Withdrawal

Under Section 18(1)(10) of the Austrian Distance and Off-Premises Contracts Act (FAGG), there is no statutory right of withdrawal for services related to leisure activities or the provision of food and beverages where the contract specifies a particular date or period for performance.

This applies in particular to:

  • Admission tickets, including group, school and kindergarten tickets, for a specific visit date;
  • Slide tickets for a specific visit date;
  • Bookings for events such as New Year’s Eve, Valentine’s Day and other leisure events scheduled for a specific date;
  • Guided tours on a specific date;
  • Combination tickets for a specific date or period, provided the statutory requirements are met;
  • Additional services booked for a specific date, such as cakes and romantic packages, insofar as they fall within the statutory exception.

For workshops, whether a statutory right of withdrawal exists depends on the nature and structure of the booked service. A scheduled workshop date alone does not automatically exclude the right of withdrawal.

Voluntary cancellation, rebooking or refunds are only available if expressly provided for in the relevant product-specific conditions or if Donauturm expressly agrees to an exception. Mandatory statutory rights remain unaffected.

Annual Passes and Immediate Commencement of the Service

Annual passes purchased online are generally subject to a statutory right of withdrawal of fourteen days from the conclusion of the contract.

If you expressly request during checkout that Donauturm begin providing the service before the statutory withdrawal period expires, your annual pass will be activated immediately once payment has been received in full and can be used straight away.

During checkout, you also expressly confirm that you acknowledge that your right of withdrawal expires once Donauturm has fully performed the contract. Using your annual pass for the first time does not automatically extinguish your right of withdrawal.

If you validly exercise your right of withdrawal, your annual pass will be blocked upon receipt of your withdrawal declaration.

A proportionate payment for services already provided is only due if the statutory requirements are met, particularly if you received the required information before concluding the contract and expressly requested that the service begin during the withdrawal period.

The amount is calculated proportionately according to time: the annual pass price actually paid is divided by the number of usable days within the agreed validity period. The resulting daily amount is multiplied by the number of usable days that have elapsed up to receipt of your withdrawal declaration. Contractually excluded days and closure days are disregarded in both periods.

On the activation date and the date on which your withdrawal declaration is received, only the elapsed portions of time during which the annual pass was usable within regular opening hours are taken into account. Partial days are not rounded up to full days. The documented activation time and the time at which your withdrawal declaration is received are decisive.

The legally permissible proportionate amount is deducted from the annual pass price to be refunded.

Monetary Vouchers

Monetary vouchers purchased online are generally subject to a statutory right of withdrawal of fourteen days from receipt of the voucher. The day on which you receive the voucher is not included when calculating this period.

You can submit your withdrawal declaration using our electronic withdrawal function, by email or by post. Using a form is not mandatory.

If you validly exercise your right of withdrawal, the relevant voucher will be blocked and can no longer be redeemed. After submitting your withdrawal declaration, you must neither use the voucher code nor pass it on to another person.

If the voucher has already been fully or partially redeemed, the conditions and legal consequences of withdrawal will be assessed individually in accordance with the applicable law.

For vouchers that apply exclusively to a leisure service scheduled for a specific date or period, the statutory right of withdrawal may be excluded.

Refunds following a valid withdrawal are made in accordance with the provisions described below.

Consequences of a Valid Withdrawal

If you validly withdraw from a contract, we will reimburse all payments received from you, including any delivery costs. This does not include additional costs resulting from your choice of a type of delivery other than the least expensive standard delivery offered by us.

The reimbursement will be made without undue delay and no later than fourteen days from the date on which we receive your withdrawal declaration.

Unless expressly agreed otherwise, we will use the same payment method for the reimbursement that you used for the original transaction. You will not incur any additional fees as a result of the reimbursement.

If you expressly requested that a service begin during the withdrawal period, a reasonable proportionate amount may be payable for the services provided up to receipt of your withdrawal declaration. This applies only if the statutory requirements are met, particularly if the required information was provided before the contract was concluded.
