APPLICABILITY OF THE GENERAL TERMS AND CONDITIONS (GTC) – ONLINE & ON-SITE PURCHASE VERSION 2025/11

1. SCOPE

1.1. The following General Terms and Conditions apply exclusively to all present and future business transactions carried out with Donauturm Aussichtsturm- und Restaurantbetriebsgesellschaft m.b.H, Donauturmplatz 1, 1220 Vienna, FN99156v (hereinafter “Donauturm”) via the websites www.donauturm.at, www.shop.donauturm.at and on site purchases at the cashdesk oder Frontdesk. Their applicability is agreed even if these GTC are not explicitly referenced.
1.2. The customer’s general terms and conditions shall only become part of the contract if expressly confirmed in writing by Donauturm. Acts of performance shall not be deemed as agreement to any contractual terms that deviate from these GTC.
1.3. The contract language is German.

2. OFFER / CONCLUSION OF CONTRACT

2.1. Unless the binding nature of an offer has been expressly agreed, all offers made by Donauturm are subject to change. An order placed by a customer is deemed accepted only when the customer clicks the button “order with obligation to pay”. At this point, the contract is considered concluded. Digital tickets and vochers are deemed delivered once they have been made available to the customer via email or download link.
2.2. Donauturm reserves the right to reject offers from potential customers without giving reasons or to refrain from entering into any contractual relationship with certain customers.
2.3. When registering, the customer must provide complete and truthful information including first and last name, date of birth, deliverable address (no P.O. boxes), a valid email address, and telephone number, as well as company details and representation authority if applicable. If any data changes after registration, the user is obligated to update the information without delay.
2.4. Donauturm is entitled to verify the identity of customers and their eligibility for specific ticket categories by requesting official photo identification.
2.5. Donauturm will only begin processing the order once the customer’s payment has been received. For digital tickets, value vouchers, additional services and event tickets, the customer receives usage rights only after full payment.

3. PRICE, PAYMENT TERMS

3.1. Unless expressly agreed or stated otherwise, all prices are in euros and include VAT.
3.2. Donauturm reserves the right to adjust prices in the future.
3.3. Payment is made exclusively using the payment methods offered in the online shop. The full purchase price is due immediately upon submission of the order.
3.4. If a chargeback occurs before the service date, the ticket or voucher immediately becomes invalid.

4. DIGITAL PROVISION OF TICKETS AND VOUCHERS

4.1. Admission tickets are provided solely in digital form as QR codes. Printing is not possible. The customer is responsible for safely storing the tickets. Re-provisioning cannot be guaranteed.
4.2. Entry is granted by presenting the QR code at Donauturm’s access system. The customer is responsible for ensuring that their mobile device (e.g., smartphone, tablet) is functional and that the QR code can be displayed in a readable manner. Donauturm assumes no responsibility for technical issues caused by the customer’s device (e.g., defective display, empty battery, missing software).
4.3. Donauturm admission tickets can be stored in Apple Wallet and Google Wallet. For combination tickets, this applies only to the Donauturm portion; third-party services (e.g., immersive shows) are excluded.
4.4. Vouchers and invoices are digitally transmitted to the customer after successful payment and provided via a download link. The customer must download and store the voucher safely without delay. Re-provisioning cannot be guaranteed.
4.5. Emails from Donauturm are considered delivered once sent to the last email address provided by the customer. The customer is responsible for ensuring the availability of the email address, including mailbox functionality, spam filters, and sufficient storage space.
4.6. The customer bears sole responsibility for any disclosure of ticket numbers, QR codes, or voucher data. Any misuse—including unauthorized duplication or distribution—is the sole responsibility of the customer. Donauturm is entitled to block unlawfully used or manipulated tickets and vouchers.
4.7. Tickets purchased on-site are subject to the same terms of use as tickets purchased online.

5. RIGHT OF WITHDRAWAL / EXCHANGE AND RETURNS

5.1. Value vouchers are subject to the right of withdrawal under §§ 11 ff. FAGG. The withdrawal period is 14 days from the day the voucher is first made available digitally to the customer.  This is not valid for vouchers purchased on-site.
5.2. Under § 18 para. 1 no. 10 FAGG, there is no right of withdrawal for services tied to a specific date or time slot. This includes in particular: admission and slide tickets, annual tickets, event tickets (e.g., New Year’s Eve, Valentine’s Day), guided tours, additional services such as cakes or romance packages, and combination tickets.
5.3. Rebooking or refunds are excluded unless explicitly stated otherwise in the product-specific terms under section 6.

6. PRODUCT-SPECIFIC TERMS

6.1. Value Vouchers: Value vouchers represent a credit balance towards Donauturm and are valid for 30 years from the date of issue. They become valid only after full payment. Value vouchers may be redeemed once; cash redemption—including of remaining balances—is excluded. They may not be used to purchase additional vouchers. Redemption is only possible for the services indicated on site; use for events or in-house special events is excluded.
6.2. Admission and Slide Tickets: Admission tickets are valid only on the booked day and within the booked time slot. If guests arrive late, the right to fast-lane access expires; the ticket remains valid as regular admission.
Annual passes are personal, non-transferable, and valid only with official photo ID. They are not valid on December 31, January 1, or on closure days due to maintenance.
Children under 14 may enter only when accompanied by an adult; supervision is the responsibility of the accompanying person. Children under 3 receive a free ticket only at the ticket desk and only in combination with an adult or senior ticket.
When making a reservation at the Tower Restaurant or the Tower Café, you can take advantage of reduced admission prices; the required code will be sent together with the reservation confirmation, which also includes a link to your personal information page. The discount is granted exclusively by entering your personal discount code; retroactive discounts on already purchased tickets are not possible..
Slide tickets may only be used by persons who are at least 110 cm tall and at least 6 years old. Slide fun packages are not personal and may be used by different individuals.
6.3. Additional Services: Romance packages: Free cancellation until 1 business day before the service date; thereafter 100% cancellation fee.
Cakes: Orders possible until 5 business days before the date; free cancellation up to 3 business days before; thereafter 100% cancellation fee.
6.4. In-House Events and Guided Tours: For in-house events (e.g., New Year’s Eve, Valentine’s Day, special events) no cancellation rights apply; 100% cancellation fees are due. Guided tours are subject to their own additional terms; if the minimum number of participants is not reached, the date may be cancelled and the booked service will be refunded.
6.5. Combination Tickets: Combination tickets include two separate contractual relationships: a) the admission ticket for Donauturm, and b) the ticket of the respective cooperation partner. The Donauturm ticket is provided digitally as a QR code; the partner ticket is issued at the partner’s ticket office. The customer acknowledges the general terms and conditions of the cooperation partner as part of the second contractual relationship.
6.6. Opening Hours and Operational Limitations: Donauturm reserves the right to change opening hours at short notice or temporarily close certain areas (especially lifts, observation decks, slide, or gastronomy) for technical, operational, or safety reasons.
Refunds are only granted in cases of complete cancellation of the booked service.

7. LIABILITY

7.1. Donauturm is liable for property damage only in cases of intent or gross negligence. Liability for slight negligence is excluded, except for personal injury.
7.2. The duplication, distribution, alteration, or manipulation of digital tickets, QR codes, or ticket numbers is prohibited. Donauturm is entitled to block manipulated, falsified, or unlawfully obtained tickets; no replacement claims may be made in such cases.
7.3. Donauturm assumes no liability for outages, interruptions, or technical disruptions of the website or online shop unless caused by intentional or grossly negligent behavior by Donauturm.
7.4. By purchasing or using a ticket, the customer accepts the house rules and all safety regulations of Donauturm in their current version. For safety reasons, instructions from staff must be followed without exception.

8. FINAL PROVISIONS

8.1. If any provision of a contract is or becomes invalid or unenforceable, this shall not affect the validity of the remaining provisions. In such cases, the parties shall endeavor to replace the invalid or unenforceable provision with a valid and enforceable one that comes as close as possible to the intended purpose. The same applies to contractual gaps.
8.2. All contracts concluded by Donauturm are subject to Austrian substantive law, excluding the conflict-of-law rules of international private law. The UN Convention on Contracts for the International Sale of Goods does not apply.
8.3. For all legal disputes regarding the conclusion or validity of a contract or in connection with a contract, including pre- and post-contractual effects, exclusive jurisdiction of the competent court at the registered office of Donauturm is agreed. For customers who are consumers within the meaning of the Consumer Protection Act (KSchG), the court responsible is the one in the district of the customer’s residence, habitual residence, or place of employment.
8.4. Donauturm reserves the right to amend these GTC at any time. Such amendments will be announced separately and apply only to contracts concluded after the amendment and publication of the GTC.
